Japanese overseas casino and sports-betting winnings seek a formal tax clarification

20 October 2026

Amid booming interest in overseas online gambling, Japan's tax regime is urgently seeking to give more targeted guidance on how to treat international sports-betting and casino winnings.

With the Japanese tax system widely explained but not explicitly tailored to foreign casinos and sportsbooks, the National Tax Agency (NTA) is facing calls to clarify the treatment of overseas gambling earnings.

Under Japan's Income Tax Act and related NTA guidelines, foreign casino winnings are commonly explained as occasional income (一時所得). This means that gaming winnings are treated as one-time income, with the taxable amount calculated as total earnings minus the money spent to achieve those earnings, wth a ¥500,000 deduction limit.

However, sports betting is not addressed as explicitly. As Japan's online gambling laws do not create a specific definition for sports-betting winnings, they must be analogized from the general occasional income rules, along with other related guidance.

I don't believe there are any concrete rules on overseas sports-betting winnings, so enforcement applies the broad general rules on special income, explained Miki Shimamoto, Tokyo-based accountant.

The current guidance can still be confusing, leaving sportsbetting and casino players applying a range of principles by analogy with little certainty. To illustrate this ambiguity, a Tokyo District Court baccarat ruling in 2022 held that a player's gross winnings could be calculated game by game, with stakes deductible on that same basis. But at the same time, a 2021 unpublished administrative decision ruled that winnings from settled bets could be counted as one-off income at the point of ticket acceptance.

Consequently, Japanese players are left wondering how to define and report their yearly overseas gambling wins, especially since Japan's taxation of local sources is clear but the extraterritorial application can be less obvious.

There's simply no strict rule on how to classify and report overseas online winnings, said Hideko Nakamura, a local tax auditor. Some people could overreport and pay too much, others underreport and deal with retroactive assessments. It can be hard to follow consistently.

The NTA has issued general tax procedures for taxpayers living overseas, as well as overseas tax collection protocols, but has not created standalone rules to clarify the points of ambiguity around offshore online sports betting and casino winnings. Instead, the general guidance and occasional-income regime applies.

In the absence of clear guidance, the agency has stepped up its reminders for overseas gamblers to report winnings, raising enforcement risk as Japan's international airport infrastructure and legalized domestic casino regulations develop.

As the legalized casinos develop in Japan, I expect pressure to increase, said Tadashi Ogasawara, chair of the NTA Committee on Special Cases.

Two legal developments have not clarified this further. The Tokyo District Court's 2022 baccarat ruling relied in part on the idea that since foreign online casinos offer virtual currency, the economic value of chips is treated as income at point of accrual. Even if a cash-out or wagering requirement exists, betting wins sit in the taxpayer's balance at the time of the win, the court held.

Separately, the unpublished 2021 decision provides conflicting guidance, stating that foreign casino chips count as one-time income upon cashing out winnings, creating a clearer moment of gain recognition. This appears at odds with the baccarat ruling's earlier accrual of income.

No formal guidance exists to clarify these points, meaning unique scenarios could be separately ruled, and Japanese overseas gamblers are still looking for something more final.

A call for comment was not returned by the NTA.
